Licensing request

General terms and conditions for the use of test results, classification reports and technical documentation of ITT (initial type test) of Forster Profilsysteme AG (in the following: ”License documents”) for the following profile systems:

 

  • Curtain wallings (forster thermfix vario and forster thermfix light) within the scope of CE* certification as per product standard EN 13830.

  • Windows and doors with or without requirements for fire and/or smoke protection (forster unico, forster unico xs, forster fuego light, forster omnia, forster presto, forster presto xs, forster norm) within the scope of CE* certification as per product standard EN 14351-1 as well as in combination with EN 16034. 

In accordance with the EU construction product regulation (CPR).

 

These Forster licensing terms represent a binding offer for concluding a licensing agreement. By submitting the registration form, this agreement is concluded and you or the juristic person you represent (in the following: ”Customer”) undertake to recognise the terms and conditions of use of Forster Profilsysteme below as legally binding and to comply with them. For this reason, only submit the registration form to us if you accept the following licensing terms.

 

After accepting this method for concluding this agreement, a screen opens containing a registration form, where you enter the exact data for the contract partner. After completing all fields marked with an *, you will receive an activation code for using the information and download areas.


 
Terms and conditions of use:

Forster Profilsysteme has, for its

  • Systems for curtain walls (forster thermfix vario, forster thermfix light) type testing in accordance with harmonised standard EN 13830

  • Systems for windows and doors without requirements for fire and / or smoke protection (forster unico, forster unico xs, forster fuego light, forster omnia, forster presto, forster presto xs, forster norm) type testing in accordance with harmonised standard EN 14351-1

  • Systems for windows and doors (forster unico, forster unico xs, forster fuego light, forster omnia,  forster presto, forster presto xs, forster norm) type testing in accordance with harmonised standard EN 14351-1 as well as in combination with EN 16034 


commissioned a notified test body to perform all ITT (initial type testing) as required by law. The results of this ITT are documented in the license documents.

 

Based on the agreement concluded by submitting the registration form, the customer is authorised to open, print out or download the license documents. To use these license documents, the customer stipulates the following terms with Forster Profilsysteme.

 

Usage rights:

Forster Profilsysteme AG has the clear title for the incorporeal and intellectual property rights expressed in the license documents. With this licensing agreement, the customer is granted the following paraphrased, limited right to use the license documents.

 

License:

Forster Profilsysteme grants the customer the free, non-exclusive, Europe-wide, unlimited and non-transferable precarious right to use, print and save the license documents on a computer provided they are required to certify product compliance. The use in networks is only permitted with prior written permission of Forster Profilsysteme. The customer undertakes to treat the license documents as confidential and only provide them to individuals outside the company that have a legal claim to viewing the documents. Any changes, alteration or sharing of the license documents, in particular the product pass/system pass/classification report are prohibited.

 

The classification report and technical documentation may only be used by the customer in the framework of CE* certification/conformity procedure in accordance with harmonised European standards under the suspensive condition that the customer has used the processing and assembly procedures specified in the classification report and technical documentation, observed the relevant Forster Profile Systems processing and assembly guidelines, and exclusively used the system components or components intended or specified therein during the manufacturing of the curtain wall and/or curtain wall element, window, fixed glazing and doors.

 

Should the production process deviate from that in the classification report and technical documentation, Forster Profilsysteme will not carry out any equivalency assessments and clarifications.

 

Use of the license documents beyond that specified in the paragraphs above is prohibited and entitles Forster Profilsysteme to revoke the usage rights and order the customer to cease using the above-named documents and to return or destroy them.

 

Warranty/liability:

Forster Profilsysteme guarantees that the in findings certified in the license documents were obtained properly and are factually correct. However, Forster Profilsysteme does not guarantee that the products produced by the customer conform with the declared performance. Forster Profile Systems advises the customer explicitly that in accordance with the harmonised European standards, further prerequisites such as for example the adherence to factory production controls must be fulfilled, for which the customer alone is responsible. With this agreement, Forster Profilsysteme does not assume liability for the classification reports and technical documentation and their contents extending beyond the findings certified in the license documents.

 

In any case, the liability of Forster Profilsysteme is restricted to intent or gross negligence. In particular, Forster Profilsysteme and the customer agree that the use of the license documents does not replace professional consultation. Generally, the customer must ensure careful processing as well as compliance with the rules of engineering during the manufacture of curtain facades and/or curtain facade elements, windows, fixed glazing and doors in accordance with the Forster Profilsysteme processing and assembly guidelines.

 

This agreement is subject to Swiss material law, with the jurisdiction being the place of business of the licensor, Romanshorn, Switzerland.

 

 *In order to place products on the market in Great Britain (England, Scotland, Irland and Wales), the UKCA mark can be applied as an alternative to the CE mark. The UKCA mark will become mandatory in the future. Further information can be found at: gov.uk .
